Article 1: Scope of Application and Amendment of the General Terms and Conditions of Sale<\/strong>These general terms and conditions of sale (hereinafter “General Conditions”) apply to the relationship between Univers Sant\u00e9 S\u00e0rl and any person placing an order on the website universsante.ch (hereinafter: the “Customer” or “Customers”).<\/p>\n\n

Univers Sant\u00e9 S\u00e0rl reserves the right to adapt or modify the General Conditions at any time, which shall be immediately applicable to any new order.<\/p>\n\n

With each order, the Customer must confirm that they have read and accepted the General Conditions. These conditions thus apply to all orders placed by the Customer (hereinafter: the “Order”). <\/p>\n\n

Article 2: Products Mentioned on the Websites and Customer Orders<\/strong>Products visible on the Website are shown for indicative purposes only and do not constitute offers on the part of Univers Sant\u00e9 S\u00e0rl. In particular, the photos appearing on the Website are not contractually binding. <\/p>\n\n

The information appearing on the site has not been verified by the Food and Drug Administration.<\/p>\n\n

All information provided on Univers Sant\u00e9 S\u00e0rl Websites (product descriptions, illustrations and photos, films, dimensions, weight, technical specifications, accessories, and other data) is provided for information purposes only and is in no way a formal guarantee of these characteristics. Only the manufacturer’s specifications are authoritative. <\/p>\n\n

Based on this non-contractual information, the Customer may place an order for the displayed product(s), exclusively through the procedure provided by the Website and by respecting the ordering terms set out on the Website.<\/p>\n\n

Any Order, once finalized according to the ordering process available on the Website, constitutes a firm offer by the Customer. They decide to purchase the product displayed on the Website under the conditions indicated therein. <\/p>\n\n

For each Order, the Customer must provide an email address to which all communications from Univers Sant\u00e9 S\u00e0rl regarding the Order will be sent. It is the Customer’s responsibility to maintain this address as valid and to read the emails sent by Univers Sant\u00e9 S\u00e0rl. Any communication sent by Univers Sant\u00e9 S\u00e0rl to the address indicated by the Customer will be considered received by the Customer on the same day it is sent. Transmission and delivery risks are assumed by the Customer. <\/p>\n\n

The Customer may notify Univers Sant\u00e9 S\u00e0rl of a potential change in delivery address within 5 business days following the Order. However, this will only be taken into account if the Order has not yet been sent to the Customer. Otherwise, it will be the Customer’s responsibility to take appropriate measures to receive the Order at the delivery address indicated at the time of the Order. <\/p>\n\n

Article 3: Validation of Orders \u2013 Firm and Non-Cancellable Orders<\/strong>To place an Order, the Customer must be of legal age (at least 18 years old) and not be under guardianship or curatorship. The Customer ensures that all information provided is accurate and is consequently liable to Univers Sant\u00e9 S\u00e0rl for any damage related to inaccurate information. <\/p>\n\n

The Order placed by the Customer in accordance with Article 2 above constitutes a firm and final offer to purchase the product indicated on the Website. Once definitively validated by the Customer, this Order cannot be withdrawn by the Customer; the decision to accept or refuse belongs solely to Univers Sant\u00e9 S\u00e0rl. <\/p>\n\n

Univers Sant\u00e9 S\u00e0rl shall be free to accept or refuse any order from a Customer without stating the reasons. Univers Sant\u00e9 S\u00e0rl will communicate its decision of acceptance via an email sent to the address indicated by the Customer (order confirmation) or by confirmation of the shipment of the goods (delivery note). <\/p>\n\n

Article 4: Selling Price<\/strong>Univers Sant\u00e9 S\u00e0rl reserves the right to modify its selling prices at any time but undertakes to apply the rates displayed at the time of the Order.<\/p>\n\n

The prices indicated are expressed in Swiss francs and include all taxes (VAT, third-party fees). Delivery costs are included in the set price. <\/p>\n\n

The prices indicated are only valid within the territories of Switzerland and the Principality of Liechtenstein.<\/p>\n\n

Article 5: Advance Payment and Security<\/strong>The Customer’s offer to order a product from Univers Sant\u00e9 S\u00e0rl implies advance payment of the Order amount.<\/p>\n\n

Advance payment is made on the secure banking or postal servers of Univers Sant\u00e9 S\u00e0rl’s partners, as offered on the Website. This implies that no banking or postal information concerning the Customer passes through Univers Sant\u00e9 S\u00e0rl’s sites. Payment by bank or postal card is therefore perfectly secure. <\/p>\n\n

The order will be recorded and validated upon acceptance of the payment by the payment system chosen by the Customer. Their Order will be validated and their card debited automatically at the time the Order is recorded. <\/p>\n\n

The Customer must complete the Order form provided on the Website before it can be validated. The Customer’s credit card or Postcard details are encrypted using the SSL (Secure Socket Layer) protocol and never pass through the network in plain text. Advance payment is made directly to the bank or Post Office. The card number is not sent to Univers Sant\u00e9 S\u00e0rl. <\/p>\n\n

The risk of a payment system malfunction is borne by the Customer.<\/p>\n\n

Article 6: Delivery Terms and Deadlines<\/strong>Products are delivered to the delivery address indicated by the Customer in the Order. Risks related to the shipment of goods to the Customer (risk of loss, destruction, incorrect delivery address, etc.) are borne by the Customer from the moment Univers Sant\u00e9 S\u00e0rl hands over the goods to the carrier designated by Univers Sant\u00e9 S\u00e0rl. In the event of an error in the recipient’s contact details, Univers Sant\u00e9 S\u00e0rl cannot be held responsible for the carrier’s inability to deliver the product. <\/p>\n\n

Costs inherent to the return of an unclaimed shipment and its potential reshipment are the responsibility of the Customer. Before any reshipment, Univers Sant\u00e9 S\u00e0rl may request the Customer to pay the related costs in advance. <\/p>\n\n

In the case of an unclaimed shipment, Univers Sant\u00e9 S\u00e0rl cannot be held responsible, including in cases where the post office does not leave a delivery notice. Return costs and the risks inherent to this transport are the responsibility of the Customer. <\/p>\n\n

In the event of a shipment being returned to Univers Sant\u00e9 S\u00e0rl’s premises due to an inability to deliver (postal deadlines exceeded, incorrect recipient address, etc.), the Customer is automatically notified by an email sent to the address indicated in the Order. Without news from the Customer within 3 months of the email being sent, Univers Sant\u00e9 S\u00e0rl reserves the right to cancel the order. In such a case, Univers Sant\u00e9 S\u00e0rl is released from its obligation to deliver the goods, and the advance paid by the Customer to Univers Sant\u00e9 S\u00e0rl at the time of the order will be retained by Univers Sant\u00e9 S\u00e0rl as liquidated damages, in full and final settlement of any account and any claim for the Order in question. <\/p>\n\n

All items are generally shipped within 5 business days (weekends and public holidays are excluded from this period). The indicated deadlines are average times and correspond to the processing, preparation, and shipping times of any Order (leaving the warehouse). <\/p>\n\n

In the event that Univers Sant\u00e9 S\u00e0rl is unable to deliver the ordered goods within 20 days (date of leaving the warehouse), the Customer may cancel the Order by email or by letter addressed to Univers Sant\u00e9 S\u00e0rl’s customer service, mentioning the Order references. This cancellation will only be taken into account if it reaches Univers Sant\u00e9 S\u00e0rl 24 hours before the ordered goods are handed over to the carrier designated by Univers Sant\u00e9 S\u00e0rl. Otherwise, the order can no longer be cancelled. Furthermore, the cancellation must reach Univers Sant\u00e9 S\u00e0rl before the expiry of a 30-day period after the order. <\/p>\n\n

In the event of a valid cancellation, the advance paid by the Customer at the time of the Order will be refunded in full and final settlement of any account and claim. The Customer may in no way claim additional damages from Univers Sant\u00e9 S\u00e0rl, their claims being limited exclusively to the full restitution of the advance paid. <\/p>\n\n

Univers Sant\u00e9 S\u00e0rl is also entitled to cancel an order even if accepted, without needing to state the reasons to the Customer. In such a case, the Customer’s claims against Univers Sant\u00e9 S\u00e0rl are limited to the restitution of the advance paid, to the exclusion of all damages. <\/p>\n\n

Upon receipt of the Order by the Customer, the latter must proceed with the immediate inspection of the delivered goods.<\/p>\n\n

To identify apparent defects (packaging defects, delivered product not corresponding to the ordered product, potential missing product, etc.), the Customer must check the conformity of the delivered goods before opening them. They must immediately report the observed defect by email and wait for instructions from Univers Sant\u00e9 S\u00e0rl for further processing. <\/p>\n\n

Article 7: Liability<\/strong>Univers Sant\u00e9 S\u00e0rl is only liable for direct damages that the customer proves were caused by gross negligence on the part of the company or a mandated third party. Any liability for light fault or simple negligence is excluded. <\/p>\n\n

In the event of liability on the part of Univers Sant\u00e9 S\u00e0rl, it is limited to the price of the delivered product or the service provided. Any more extensive liability of Univers Sant\u00e9 S\u00e0rl, its auxiliaries, or third parties mandated by it for damages of any type whatsoever is excluded. In particular, the Customer has no claim for compensation for damages not affecting the product itself. <\/p>\n\n

The choice and purchase of a product are the sole responsibility of the Customer. The total or partial inability to use the products, notably due to equipment incompatibility, cannot give rise to any compensation, refund, or questioning of Univers Sant\u00e9 S\u00e0rl’s liability. <\/p>\n\n

In all cases, any claim for damages will be limited to the maximum amount corresponding to the price paid by the Customer at the time of their Order.<\/p>\n\n

Article 8: Warranty \u2013 Limitation of Warranty \u2013 Return Procedure<\/strong>The warranty for hidden defects is limited to a maximum of one month (from the date of departure from our warehouses). Beyond this period, Univers Sant\u00e9 S\u00e0rl will not accept any claims. The existence of a longer manufacturer’s warranty is reserved (see Chapter 9 below). <\/p>\n\n

Before returning a purchased product due to a defect or non-conformity covered by Univers Sant\u00e9 S\u00e0rl’s warranty, the Customer must imperatively make a prior request to Univers Sant\u00e9 S\u00e0rl’s Customer Service within 3 days of discovering the defect and obtain a return authorization number (RMA) and instructions on the return procedure from said service.<\/p>\n\n

No returned goods will be accepted if they are not in their original packaging or if the return of the goods was not preceded by an RMA request to Univers Sant\u00e9 S\u00e0rl’s customer service.<\/p>\n\n

Upon receipt of the RMA, the Customer has 5 days to return the defective product to Univers Sant\u00e9 S\u00e0rl. After this period, any return will be refused. The return must be made by registered parcel, with the Customer bearing the risks and costs associated with this return. <\/p>\n\n

For defective products returned by the Customer in accordance with the procedure set out in this chapter, Univers Sant\u00e9 S\u00e0rl’s obligations are limited, at the exclusive choice of Univers Sant\u00e9 S\u00e0rl:<\/p>\n\n
